1:09 p.m. By a vote of 47-52, the decision of the Chair is not sustained that the threshold for cloture on en bloc nominations requires 60-votes. It was a party line vote with Senator Lee not voting.
12:30 p.m. The Senate began a roll call vote on the motion to appeal the ruling of the Chair with respect to the nominations included in S. Res. 377.
12:28 p.m. Majority Leader Thune made a point of order that consistent with the precedent the Senate established the threshold for cloture on the en bloc consideration of the nominations is a simple majority. The Chair ruled that the precedent set on November 21, 2013 and September 11, 2025, do not apply to the considerations of the en bloc nominations. Majority Leader Thune then appealed the ruling of the Chair and asked for the yeas and nays.
12:28 p.m. By a vote of 51-47, the Senate agreed to the motion to reconsider the motion to invoke cloture on the nominations included in S. Res. 377, party line. Senators Lee and Tillis did not vote.
11:49 a.m. The Senate began voting on the motion to reconsider the motion to invoke cloture on the en bloc nominations included in S. Res. 377.
11:48 p.m. By a vote of 51-48, the Senate did not invoke cloture on the en bloc nominations included in S. Res. 377. Senator Lee did not vote. Majority Leader Thune voted no in order to make a motion to reconsider.

The Senate will convene at 10:00 a.m. Following Leader remarks, the Senate will resume consideration of S.2296, the National Defense Authorization Act.
At approximately 11:00 a.m., the Senate is expected to proceed to four roll call votes relative to the following:
- Motion to invoke cloture on the 48 nominations included in S.Res.377, en bloc. (60-vote affirmative threshold, if cloture is not invoked, then Majority Leader Thune is expected to enter a motion to reconsider the failed cloture vote.)
- Motion to reconsider the failed cloture vote. (Senator Thune is then expected to raise a point of order that cloture on nominations en bloc should be at a majority threshold.)
- Shall the decision of the Chair stand that the threshold for cloture on en bloc nominations is 60-votes? (If the Chair is overruled and the threshold is lowered, the Senate is then expected to vote on the motion to invoke cloture on the nominations en bloc, upon reconsideration.)
- Motion to invoke cloture on the 48 nominations included in S.Res.377, en bloc, upon reconsideration. (Majority threshold)
If cloture is invoked on the nominations, en bloc, there would be up to 30 hours of debate, then the Senate would proceed to a roll call vote on confirmation of the nominations, en bloc.
