8:05 p.m. The Senate stands in recess until 11:00 a.m. on Tuesday. Following Leader remarks, the Senate will resume consideration of the Davidson nomination post-cloture. At approximately 2:20 p.m., the Senate will vote on confirmation of the Davidson nomination. Upon disposition of the nomination, unless further agreement is reached, the Senate would vote on the motion to invoke cloture on Executive Calendar #465 Amitabha Bose, to be Administrator of the Federal Railroad Administration.

8:02 p.m. ML Schumer continued wrap up:

• Passed S.450 – Congressional Gold Medal to Emmett Till and Mamie Till-Mobley w/Burr sub amendment – by unanimous consent.
• Passed S.3451 – FAST Act – by unanimous consent.
• Adopted S.Res.486 – Interscholastic Athletic Administrators’ Day – by unanimous consent.

7:59 p.m. ML Schumer asked unanimous consent that the Senate vote on passage of the bills S. 2747, the Freedom to vote act, S. 4, the John Lewis Voting Rights Act and S. 3452-S.3469 (listed below). RL McConnell objected.

7:55 p.m. ML Schumer began the Rule XIV process on the following bills:

• S. 3452, a bill to ensure that state and local enforcement may cooperate with federal officials.
• S. 3453, a bill to prohibit the payment of certain legal statements to individuals who unlawfully entered the U.S.
• S. 3454, a bill to clarify rights of Indian tribes.
• S. 3455, a bill to prohibit the implementation of new requirements to report bank account deposits and withdrawals.
• S. 3456, a bill related to waters of the United States
• S. 3457, a bill to codify the temporary scheduling order for Fentanyl related assistance.
• S. 3458, a bill to amend Title 18 of U.S. code.
• S. 3459, a bill to prohibit a federal agency from promulgating any rule or guidance.
• S. 3460, a bill to prohibit local educational agencies from obligating certain federal funds.
• S. 3461, a bill to provide that the rules submitted by the Department of Labor relating to Covid-19 vaccination and testing shall have no force or effect.
• S. 3462, a bill to require U.S. Immigration and Customs enforcement take into custody certain aliens.
• S. 3463, a bill to impose sanctions and other measures in response to the failure of the government of the People’s Republic of China.
• S. 3464, a bill to preserve and protect the free choice of individual employees.
• S. 3465, a bill to clarify the treatment of two or more employers as joint employers.
• S. 3466, a bill to prohibit the use of federal funds for the production of programs.
• S. 3467, a bill to withhold U.S. contributions to the United Nations.

7:55 p.m. By a vote of 64-30, the Senate invoked cloture on the nomination of Alan Davidson to be Assistant Secretary of Commerce for Communications and Information. Not voting: Senators Cassidy, Feinstein, Hoeven, Hyde-Smith, Ossoff and Sanders.

5:26 p.m. The Senate began a roll call vote on the motion to invoke cloture on the nomination of Alan Davidson to be Assistant Secretary of Commerce for Communications and Information.

4:57 p.m. Senator Blackburn spoke on voting rights and election laws.

4:30 p.m. Senator Cornyn spoke about the Biden Administration and voting rights.

4:04 p.m. Senator Grassley spoke about adoption, the filibuster and Russia.

3:45 p.m. Senator Durbin spoke on the Garland Supreme Court vacancy, on voting rights legislation and on Lithuanian’s Bloody Sunday.

3:33 p.m. RL McConnell spoke on protecting the legislative filibuster.

3:19 p.m. ML Schumer spoke on the Bronx apartment fire and on voting rights legislation,

The Senate will convene at 3:00 p.m., and following Leader remarks will resume consideration of Executive Calendar #612 Alan Davidson to be Assistant Secretary of Commerce for Communications and Information.

At approximately 5:30 p.m., the Senate will vote on cloture on the Davidson nomination.

Cloture has also been filed on the following nomination: Executive Calendar #465 Amitabha Bose to be Administrator of the Federal Railroad Administration.

Unanimous consent agreements:

1. At a time to be determined no later than January 14, the Senate proceed to the consideration of S.3436, regarding Nord Stream 2 pipeline for up to two hours of debate, after which vote on passage of S.3436, with 60-affirmative votes required for passage, with no amendments in order.
2. At a time to be determined, the Senate will vote on confirmation of Holly Thomas to be US Circuit Judge for the Ninth Circuit.
3. At a time to be determined, the Senate will vote on confirmation of Gabriel Sanchez to be US Circuit Judge for the Ninth Circuit.
