8:28 p.m. By a vote of 50-48, the Senate agreed to motion to concur with the Schumer amendment in the nature of a substitute (3847) to the the motion to concur to the House Amendment to S. 1301 (debt Ceiling vehicle).

This was a party line vote. Senator Burr and Blackburn were absent.

8:06 p.m. The Senate began a roll call on the motion to concur in the House amendment to S.1301, vehicle for the Debt Limit, with a further amendment.

3:49 p.m. Senator Schumer announced that following disposition of the motion to discharge from the HELP Committee PN572, Catherine Elizabeth Lhamon, CA, to be Assistant Secretary for Civil Rights, Department of Education, that there be up to 4 hours of debate on the motion to concur in the House Amendment to S. 1301 followed by a vote on the motion to invoke cloture on the motion to concur with an amendment.

If cloture is invoked all post cloture time will be yielded back, the amendment will be withdrawn and the Senate vote on the motion to Concur in the House Amendment to S. 1301.

Following that vote the Senate will vote on the motion to invoke cloture on Gustavo A. Gelpi to be U.S. District Judge for the First Circuit. If cloture is invoked a confirmation vote will occur at 5:30 p.m. on Monday, Oct. 18.

Cloture was filed on the motion to concur in the House Amendment to S. 1301 with an Amendment #3847. Cloture was filed on the motion to concur in the House Amendment to S. 1301.

Majority Leader Schumer proposed amendment #3848 to amendment #3847. The motion to refer the House Message to Accompany S.1301 with instructions to the Committee on Finance, and to report back with amendment #3849 forthwith, was agreed to by voice.

He also proposed amendment #3850 with amendment #3849 to refer to S. 1301 and a second degree amendment #3851 to amendment #3850.

The Senate will convene at 10:00 a.m. and following any Leader remarks, will proceed to Executive Session. Discussions continue on reaching an agreement to consider debt limit legislation and nominations during today’s session.
