5:09 p.m. Majority Leader Thune filed cloture on Cal #671, the nomination of Andrew B. Davis to be US District Judge of the Western District of Texas.

1:16 p.m. Senator Durbin paid tribute to recently-passed FBI Director, Robert Mueller. He then asked unanimous consent that the Senate agree to the resolution at the desk; Senator Banks objected.

1:15 p.m. By a party-line vote of 53-45, the Senate invoked cloture on the Wolfe nomination to be US District Judge of the Western District of Texas. Senators not voting: Bennet and Gallego.

12:22 p.m. The Senate is currently voting on the motion to invoke cloture on Executive Calendar #674 Christopher R. Wolfe, of Texas, to be United States District Judge for the Western District of Texas.

12:20 p.m. By a vote of 53-46, the Senate confirmed the nomination of John Shepard to be United States District Judge for the Western District of Arkansas.

11:30 a.m. The Senate is currently voting on the nomination of Executive Calendar #672 John Thomas Shepherd, of Arkansas, to be United States District Judge for the Western District of Arkansas. Senator Bennet did not vote.

The Senate convenes at 10:00 a.m. Following Leader remarks, the Senate will proceed to Executive Session and resume consideration of Executive Calendar #672 John Thomas Shepherd, of Arkansas, to be United States District Judge for the Western District of Arkansas, post-cloture.

At approximately 11:30 a.m., the Senate will vote on confirmation of the Shepherd nomination. Following disposition of the nomination, the Senate will vote on the motion to invoke cloture on Executive Calendar #674 Christopher R. Wolfe, of Texas, to be United States District Judge for the Western District of Texas.

Following the cloture vote, the Senate will recess until 2:15 p.m. to allow for the weekly caucus meetings.

At approximately 2:15 p.m., if cloture is invoked, the Senate will vote on confirmation of the Wolfe nomination.
