During wrap-up the following legislation was passed without objection:
- H.R. 4192 – Regulating Height of Buildings in DC
- S. Res. 438 – Congratulating Students, Administrators, and Teachers of Charter Schools
- S. Res. 439 – National Safe Digging Month
Post-Cloture debate on S. 2262 (energy bill) is set to expire at 5:45 p.m. tomorrow.

When the Senate resumed session after the party caucus lunches, Senator Cornyn spoke on energy issues. Senator Boxer passed S. Res 433, showing support for the kidnapping victims in Nigeria. Senator Mikulski also spoke in support of the resolution. Senator Sanders wrapped up the hour also speaking in morning business on the high cost of college.

12:05 p.m. — The majority leader filed cloture this morning on these judicial nominations:
- Indira Talwani to be a United States District Judge for the District of Massachusetts.
- James Peterson to be a United States District Judge for the Western District of Wisconsin.
- Nancy Rosenstengel to be a United States District Judge for the Southern District of Illinois.
- Robin S. Rosenbaum to be a United States Circuit Judge for the Eleventh Circuit.
All are subject to two hours of post-cloture debate, except for the Rosenbaum nomination, which is subject to 30 hours of post-cloture debate.

11:44 p.m. — On a vote of 79 to 20, the Senate invoked cloture on the motion to proceed to S. 2262. If all post-cloture time is used, the vote on the motion to proceed could occur late Wednesday afternoon.

The Senate will convene at 10 a.m.
At 11 a.m., the Senate will vote on whether to invoke cloture on the motion to proceed to S. 2262, the Energy Savings and Industrial Competitiveness Act.
The Senate will recess at 12:30 p.m. for weekly policy luncheons.
